These Terms of Service ("Terms") govern your access to and use of the OYAY LAB website at oyaylab.com (the "Site") and the purchase of OYAY LAB products (the "Products") and services (collectively, the "Services"). By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, do not use the Site or purchase Products.

OYAY LAB is operated by OYAY LAB Inc. ("Company," "we," "our," or "us").

1. Eligibility

You must be at least 18 years of age to purchase OYAY LAB products or use this Site. By using the Site, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement.

OYAY LAB home-use devices (including Iris Ice Plus, RelaxLight, Nova, and Dora) are intended for use by healthy adults. By purchasing a home device, you confirm that you have read the product's intended use description, safety guidelines, and contraindications, and that you are an appropriate user.

OYAY LAB Professional devices are sold exclusively to licensed aesthetic professionals, clinics, medspas, and medical facilities. Purchase of a professional device constitutes your representation that you or your organization holds the required professional qualifications and licenses to operate such equipment in your jurisdiction.

2. Products & Descriptions

We make every effort to accurately describe our products, including specifications, intended use, and clinical capabilities. Product images are for illustrative purposes; actual appearance may vary slightly.

OYAY LAB reserves the right to modify product specifications, discontinue products, or update product lines without prior notice. Such changes do not affect orders already fulfilled.

Medical Disclaimer: OYAY LAB products are aesthetic consumer devices, not medical devices (with the exception of FDA 510K-cleared professional systems). They are not intended to diagnose, treat, cure, or prevent any medical condition. Results vary based on individual skin type, age, consistency of use, and other factors. Consult a qualified dermatologist or physician before use if you have a diagnosed skin condition or medical concern.

3. Orders & Payment

By placing an order, you offer to purchase the selected product(s) at the stated price. We reserve the right to accept or decline any order. A binding contract is formed upon our confirmation of shipment.

All prices are displayed in US Dollars (USD) unless otherwise indicated. Prices are subject to change without notice. We are not liable for pricing errors and reserve the right to cancel orders placed at incorrect prices after notifying you.

Payment is processed by PCI-DSS compliant third-party processors. OYAY LAB does not store payment card details. By providing payment information, you authorize us to charge the stated amount. Sales tax is applied where required by applicable law.

4. Shipping & Delivery

Delivery timelines are estimates only and are not guaranteed. OYAY LAB is not liable for delays caused by shipping carriers, customs processing, natural events, or other circumstances beyond our control.

Risk of loss passes to you upon delivery to the shipping carrier. International customers are responsible for all import duties, taxes, and customs fees. See our Shipping & Returns Policy for full details.

5. Returns & Refunds

Home-use devices are eligible for return within 30 days of delivery under our satisfaction guarantee. Professional devices are final sale unless confirmed defective. Refunds are processed within 5–7 business days of receiving the returned item. Full terms are available in our Returns Policy.

Refunds are issued to the original payment method. We do not issue cash refunds for purchases made by card.

6. Warranty

Products are sold with the warranty described in our Warranty Policy. All implied warranties, to the maximum extent permitted by applicable law, are disclaimed. Our sole obligation under warranty is replacement (home devices) or repair (professional devices) as described in that policy.

7. Intellectual Property

All content on the OYAY LAB Site — including text, images, graphics, logos, product designs, and technology descriptions — is the exclusive property of OYAY LAB Inc. or its licensors and is protected by applicable copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any OYAY LAB content without prior written permission. The OYAY LAB name, logo, and product names (including Iris Ice Plus, RelaxLight, Nova, and Dora) are trademarks of OYAY LAB Inc.

8. Limitation of Liability

To the fullest extent permitted by applicable law, OYAY LAB shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our products or services, including but not limited to adverse skin reactions, dissatisfaction with results, or any other use-related outcomes.

Our total liability for any claim arising from a product purchase shall not exceed the amount paid by you for the specific product giving rise to the claim.

Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under applicable law.

9. User Conduct

You agree not to use the Site for any unlawful purpose or in any way that could harm OYAY LAB, its partners, or other users. Prohibited activities include: misrepresenting your identity, submitting false reviews, attempting to reverse-engineer our products or software, and interfering with Site security or functionality.

Any user-submitted content (reviews, comments, photos) grants OYAY LAB a non-exclusive, royalty-free, perpetual license to use, reproduce, and display such content for marketing and business purposes.

10. Privacy

Your use of the Site is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to the data practices described in the Privacy Policy.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute arising from these Terms or your use of our products shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may seek injunctive relief in a court of competent jurisdiction.

You waive any right to participate in a class action lawsuit or class-wide arbitration. If you are a consumer in a jurisdiction where mandatory arbitration clauses are unenforceable, you retain the right to bring claims in your local courts.

12. Changes to These Terms

We reserve the right to update these Terms at any time. Material changes will be communicated via email or a prominent notice on the Site. Continued use of the Site after changes are published constitutes acceptance of the updated Terms.
